RE: The tariff classification of protective sleeve from Mexico.

Dear Ms. Offerman:

In your letter dated April 19, 2010, on behalf of Ansell Protective Products, Inc., you requested a tariff classification ruling. As requested, the samples will be returned to you.

The submitted samples are of a Style 70-718 Protective Sleeve. The body of the sleeve is knit-to-shape from three yarns: man-made fiber Kevlar (yellow) that is 39 percent by weight, cotton (white) that is 21 percent by weight, and man-made fiber Kevlar and steel yarn (blue/yellow) that is 40 percent by weight. The sleeves are worn in a number of industries that require protection from sharp edges, are cut resistant, and can be worn over garments or bare skin. The protective sleeve is approximately 13-inches in length, narrows at the wrist, which is rib knit, and has an adjustable heavy duty hook and loop fastener at the top.

Section XI, Note 2 (B) (a) states that “…metalized yarn (heading 5606) are to be treated as a single textile material the weight of which is to be taken as the aggregate of the weights of its components…” Therefore, the Style 70-718 Protective Sleeve is 39 percent man-made fiber, 21 percent cotton, and 40 percent other textile material by weight. The applicable subheading for the Style 70-718 Protective Sleeve will be 6117.80.9570, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other made up clothing accessories, knitted or crocheted…parts of garments or of clothing accessories: Other accessories: Other: Other, Other.” The general rate of duty will be 14.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
